TERMS OF SERVICE

1.1 Eligibility

To use the App, you must be at least 13 years old. Users aged 13-18 may use the App only with parental or guardian consent. By creating an account, you represent and warrant that you meet these eligibility requirements and that all information you provide is accurate and truthful.

1.2 Account Registration

To create an account, you must provide a valid email address and create a secure password. You are responsible for maintaining the confidentiality of your account credentials and all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

1.3 Account Information

You agree to maintain accurate, current, and complete account information. You are responsible for updating your information if it changes. We are not liable for any losses or damages resulting from inaccurate or incomplete information provided by you.

2.1 Subscription Plans

The App offers subscription plans with varying features and pricing. Details about available plans, features, and pricing are displayed at signup and in your account settings. Subscription plans are billed on a recurring basis as specified at the time of purchase.

2.2 Payment Processing

Subscription payments are processed through Stripe, our third-party payment processor. By providing payment information, you authorize Sigma8 Labs LLC and Stripe to charge your payment method for the subscription fees. You agree to pay all charges incurred under your account, including applicable taxes.

We do not store your credit card information. All payment data is securely processed by Stripe in compliance with industry standards (PCI DSS).

2.3 Billing Cycle & Renewal

Your subscription will automatically renew at the end of each billing cycle unless canceled before the renewal date. You will receive a notification email before each renewal. Billing will continue until you cancel your subscription.

2.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. No refunds will be provided for partial months or unused subscription time. After cancellation, you will retain access to the App until the end of your paid subscription period.

2.5 Price Changes

We reserve the right to change subscription pricing with 30 days' notice. Price increases will apply to your next billing cycle. If you do not agree to the new pricing, you may cancel your subscription before the change takes effect.

2.6 Failed Payments

If a payment fails, we will attempt to charge your payment method again. If payment continues to fail, your account may be downgraded or suspended until payment is received. You are responsible for keeping your payment information current.

5.1 App Ownership

The App, including all content, features, functionality, design, code, and materials, is the exclusive property of Sigma8 Labs LLC and is protected by copyright, trademark, and other intellectual property laws. You do not own or have any claim to the App or its content.

5.2 License Grant

We grant you a limited, non-exclusive, non-transferable license to access and use the App for your personal use only. This license does not include the right to modify, copy, distribute, or create derivative works based on the App.

5.3 Your Data Ownership

You retain ownership of the data you input into the App, including shooting session data, rifle profiles, and measurements. By using the App, you grant us a license to store, process, and display this data to provide the App's services. Upon account deletion, your data will be deleted in accordance with our data retention policy.

5.4 Feedback & Suggestions

If you submit feedback, suggestions, or ideas about the App, you grant us a royalty-free, worldwide, perpetual license to use, modify, and incorporate them into the App without compensation or attribution.

5.5 Trademark & Branding

"Qual8," "Sigma8 Labs," and associated logos and trademarks are the property of Sigma8 Labs LLC. You may not use these trademarks without our express written permission.

9.1 Termination Rights

You may terminate your account at any time by deleting it through your account settings. Upon termination, your account will be deactivated, but data may be retained according to our data retention policy.

9.2 Suspension & Freezing

We reserve the right to suspend or freeze your account immediately if:

• We believe you have violated these Terms or applicable laws
• You have engaged in fraudulent or unauthorized activity
• You have failed to pay subscription fees
• We receive a legal notice or court order requiring suspension
• We identify unauthorized or suspicious account activity

9.3 Notice of Termination

We will attempt to provide notice of account termination or suspension, except in cases of emergency or legal requirement. We are not obligated to preserve your data after termination.

9.4 Effect of Termination

Upon termination, all rights granted to you under these Terms cease immediately. You remain liable for all outstanding fees and damages. Sections 5, 6, 7, 8, and 10 survive termination.

10.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles. You agree that any legal action or proceeding shall be exclusively brought in the state or federal courts located in Colorado.

10.2 Dispute Resolution

Before pursuing legal action, we encourage you to contact us at admin@sigma8labs.com to attempt to resolve any dispute.

10.3 Jurisdiction & Venue

You consent to the exclusive jurisdiction of the state and federal courts located in Colorado and waive any objections to venue or inconvenient forum.

10.4 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

11.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sigma8 Labs LLC regarding your use of the App and supersede all prior agreements, understandings, and negotiations.

11.2 Amendments

We may update these Terms at any time. Material changes will be communicated via email or notice within the App. Continued use of the App following notice of changes constitutes your acceptance of the updated Terms.

11.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

11.4 Limitation Period

Any claim or action arising out of these Terms must be brought within one (1) year of the cause of action arising, or it will be barred.

11.5 Export Compliance

The App may be subject to U.S. export control laws and regulations. You agree not to use the App or transfer App data to countries or entities prohibited by U.S. law.
